BURD LLC

Privacy Policy of Gymdex

Effective date: October 1, 2026

BURD LLC ("Gymdex", "we", "us", or "our") operates the Gymdex mobile application, the Gymdex website, and related services (together, the "Service"). This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. By creating an account or using the Service you agree to the collection, use, and sharing of your information as described here and in our Terms of Service.

Information We Collect

Information you provide

  • Account information. When you sign in with Apple we receive a unique identifier for your Apple ID, and, if you choose to share them, your name and email address (or an Apple private relay address). We use this to create and secure your account, sync your data, and contact you.
  • Onboarding and profile answers. Your answers to questions in the app, such as your motivations, training experience and consistency, what you find confusing at the gym, how you plan workouts, where you heard about Gymdex, age range, gender, and whether you are a student, along with any referral code you enter and ratings you give.
  • Workouts you save, import, build, and edit. Links to social media posts and videos you submit, workouts you save from search or the planner, workouts generated for you, and any edits you make, including titles, descriptions, and exercise lists.
  • Workout activity. Workouts you complete or log, including dates, durations, exercises, sets, reps, and weights, and your streaks, challenge progress, and schedule.
  • Settings and preferences. Notification, unit, tutorial, and other app settings.
  • Communications. Messages you send us, support requests, feedback, and survey responses.

Information collected automatically

  • Device and app data. Device model, operating system version, app version and build, language, locale, time zone, screen size, storage and memory characteristics, carrier and network type, IP address, and crash and diagnostic data.
  • Identifiers. A device identifier we generate, Apple's identifier for vendors (IDFV), and, only if you grant permission through Apple's App Tracking Transparency prompt, the advertising identifier (IDFA). We also receive an Apple Search Ads attribution token and an anonymous Meta app identifier used for ad measurement.
  • Usage data. Screens you view, features you use, buttons you tap, searches you run, workouts you open, save, share, and complete, session length and frequency, onboarding progress, and similar interaction data.
  • Purchase data. Subscription status, product, price, currency, trial and renewal dates, cancellation, refund and billing events, and Apple transaction identifiers, received through Apple and our subscription provider. We do not receive your payment card details.
  • Health data. If you allow it, we write the workouts you complete to Apple Health and may read workout data you have stored there to show it in the app. We never use Apple Health data for advertising, marketing, or data mining, never sell it, and never disclose it to third parties except as you direct.
  • Android launch waitlist. If you sign up, we collect your email address to notify you when Gymdex launches on Android. We also record your marketing email choice, when it was made, and the signup link's source.
  • Cookies and similar technologies on our website, used to operate the site, remember preferences, and measure traffic.

How We Use Information

We use the information we collect for any purpose permitted by law, including to:

  • Provide, operate, secure, and maintain the Service, including creating your account, syncing your saved workouts, history, and settings across your devices and our servers, and restoring them when you sign in on a new device.
  • Process the links and content you submit and generate, summarize, rank, and personalize workouts, weekly plans, recommendations, challenges, and reminders.
  • Personalize the Service based on your answers, activity, and characteristics such as gender and experience level, including which workouts and creators we show you.
  • Process subscriptions and trials, manage referral rewards, and detect fraud and abuse.
  • Measure and improve the Service, understand how features are used, run experiments and A/B tests, and develop new products, features, and business models.
  • Train, evaluate, and improve our automated and artificial-intelligence systems, build and enrich our workout catalog and exercise library, and create aggregated, de-identified, and derived data sets, which we may use and share freely.
  • Market the Service to you and others, including sending push notifications, emails, and in-app messages about features, offers, plans, and reminders, and measuring and attributing our advertising.
  • Communicate with you, respond to support requests, and send service notices.
  • Comply with legal obligations, enforce our Terms, protect our rights and property, and protect the safety of users and the public.

How We Share Information

  • Service providers. We share information with vendors that process it on our behalf, including cloud hosting and database providers (such as Supabase and Vercel), subscription and purchase management (RevenueCat), analytics and product measurement (such as Mixpanel), artificial-intelligence and language-model providers that process the content you submit to extract and generate workouts (such as OpenAI), push notification and email delivery, customer support tools, and content and social media data providers.
  • Advertising and attribution partners. We share device identifiers, app events such as installs, trial starts, and purchases, and, where permitted, hashed contact details with advertising platforms such as Meta and Apple Search Ads to measure the effectiveness of our advertising and to reach people likely to be interested in Gymdex. Where you have granted tracking permission this may include the advertising identifier. Under some state laws this may be considered a "sale" or "sharing" of personal information, and you can opt out as described below.
  • Apple. We share subscription and usage information with Apple as needed to process purchases, trials, and refund requests.
  • Creators and the public. Workouts in our catalog display creator names, handles, and images that are public on the originating platform. We do not publish your personal account information or activity to other users.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, your information may be transferred as part of that transaction.
  • Legal and safety. We may disclose information when we believe it is necessary to comply with law, legal process, or government requests; to enforce our Terms; to protect the rights, property, or safety of Gymdex, our users, or others; or to detect and prevent fraud, abuse, or security issues.
  • Affiliates and successors. With companies under common ownership with BURD LLC, and with any successor to our business.
  • With your direction or consent. For example when you share a workout using the share sheet, or write workouts to Apple Health.
  • Aggregated or de-identified data. We may share or sell information that does not identify you, such as statistics about workouts, exercises, creators, and usage, without restriction.

Your Choices

  • Account and data deletion. You can delete your account and the data associated with it at any time from the app's Settings screen. Deletion removes your account, saved workouts, history, and profile from our active systems; copies may remain in backups for a limited time and in aggregated or de-identified data sets.
  • Signing out. Signing out removes your synced data from that device but keeps it in your account.
  • Tracking. You can decline or revoke tracking permission in iOS Settings under Privacy & Security > Tracking, which prevents us from accessing the advertising identifier.
  • Notifications. You can turn off push notifications in the app or in iOS Settings.
  • Apple Health. You can grant or revoke Apple Health access at any time in the Health app.
  • Marketing emails. Android waitlist signup does not enroll you in product updates and offers unless you check the separate marketing box. You can unsubscribe using the link in any marketing email.
  • Opt out of sale or sharing. To opt out of the sharing of your information with advertising partners for cross-context behavioral advertising, decline tracking permission as described above or email us at the address below.

Data Retention

We keep your information for as long as your account exists and as long as needed for the purposes described above, including to comply with legal obligations, resolve disputes, and enforce our agreements. Records of purchases, saves, and events used for analytics, fraud prevention, and creator and workout rankings may be retained after you delete your account in a form that no longer identifies you. Content derived from links you submit, such as the workouts added to our catalog, is not personal to you and remains in the catalog.

Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and row-level security on your account data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your device and Apple ID secure.

International Transfers

We are based in the United States and our service providers may be located in the United States and other countries. If you use the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States and other jurisdictions whose data protection laws may differ from those where you live. By using the Service you consent to this transfer.

Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to restrict or object to certain processing, to withdraw consent, and to opt out of the sale or sharing of personal information or targeted advertising. We do not use or disclose sensitive personal information for purposes that require a right to limit under California law. You may exercise these rights using the in-app tools described above or by emailing us. We may need to verify your identity before responding. We will not discriminate against you for exercising your rights. If you are in the European Economic Area, United Kingdom, or Switzerland, our legal bases for processing are performance of our contract with you, our legitimate interests in operating, securing, improving, and marketing the Service, your consent where required, and compliance with legal obligations, and you may lodge a complaint with your local supervisory authority.

Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, contact us and we will delete it. Users between 13 and the age of majority may use the Service only with the involvement of a parent or guardian.

Third-Party Links and Platforms

The Service links to and processes content from third-party platforms and websites, including Instagram, TikTok, Facebook, and YouTube, that we do not control. Their collection and use of your information is governed by their own privacy policies. We encourage you to review them.

Changes To This Privacy Policy

We may update this Privacy Policy at any time. We will post the updated policy on this page and update the effective date above, and for material changes we may also notify you in the app or by email. Your continued use of the Service after an update takes effect means you accept the updated policy.
